效力性规定与管理性规定区分标准的探析

【摘 要】From the public law and private law,in the strict area of private law,the autonomy for the parties with the private rights is protected by the way of admitting the validity of the contract;in the strict area of public law,the national intervention of the private rights is protected by the way of denying the validity of the contract and punishing the parties;in the mixed area of public and private law,judicial practice can be guided on the base of the legal interest infringed by the object of the contract,and then the provisions of the management and effectiveness can be distinguished and concrete criteria of distinction can be finished on the operational level.%从公法与私法的角度进行区分，在严格的私法领域以承认合同效力方式保护当事人在私权领域的意思自治；在严格的公法领域以否认合同效力并对当事人进行制裁的方式来维护国家对私权利的干预；在公私混合法域，以对合同标的所侵害的法益为判断基础，从而区分管理性规定和效力性规定，在可操作层面做出具体的划分标准，从而指导司法实践工作。 【总页数】7页(P54-60) 【作 者】李峰
