论民事习惯在民法典中的角色扮演

【摘 要】Civil custom has special influence on the folk and it belongs to our native legislation resources. This paper cuts through real cases and analyzes the reasons that why civil custom has great vitality. This paper combines the legal function of civil customs and claims that our country should not only transplant and learn from western modern legislative experience, but also fully respect the original position of civil custom and pay attention to the absorption of native legislative resources during the process of making the civil code. By this, we can enrich the connotation of the civil code.%民事习惯在民间具有独特的影响力，属于我国的本土立法资源。民事习惯的形成，与我国社会的城乡二元模式有关，在法律上有补充和辅助制定法的优势。因此，通过分析民事习惯具有强盛生命力的原因，结合民事习惯的法律功能，主张我国在制定民法典的过程中，不仅需要移植、借鉴西方先进立法经验，而且也应该充分尊重民事习惯的渊源地位，注意对本土立法资源的吸纳，借以丰富民法典的内涵。
